2023\u5e7412\u67087\u65e5\uff0c\u56db\u5ddd\u7701\u5185\u6c5f\u5e02\u4e2d\u7ea7\u4eba\u6c11\u6cd5\u9662\u5f00\u5ead\u5ba1\u7406\u8d75\u6c38\u97e6\u53d7\u8d3f\u7f6a\u4e00\u6848\uff0c\u56e0\u201c\u5ba1\u5224\u957f\u4e3a\u8c0b\u53d6\u804c\u4f4d\u4e0a\u5347\u884c\u8d3f\u201d\u3001\u201c\u516c\u5f00\u5f00\u5ead\u7684\u6848\u4ef6\u9650\u5236\u65c1\u542c\u201d\u3001\u201c\u5927\u9762\u79ef\u6cd5\u5b98\u884c\u8d3f\u201d\u7b49\u5f15\u8d77\u4e86\u6781\u5927\u7684\u793e\u4f1a\u5173\u6ce8\u3002<\/p>\n\n\n\n

On December 7, 2023, the Intermediate People’s Court of Neijiang City, Sichuan Province, held a trial for Zhao Yongwei’s bribery case, which garnered significant public attention due to “the presiding judge bribing for promotion,” “restricting public trial attendance,” and “widespread bribery among judges.”<\/p>\n\n\n\n

\u503c\u5f97\u6ce8\u610f\u7684\u662f\uff0c\u9664\u4e86\u4e0a\u8ff0\u60c5\u51b5\uff0c\u5185\u6c5f\u7eaa\u59d4\u76d1\u5bdf\u59d4\u529e\u6848\u4eba\u5458\u4e0d\u987e\u7559\u7f6e\u4eba\u5458\u8eab\u5fc3\u5065\u5eb7\u80e1\u4e71\u7528\u836f\u7684\u95ee\u9898\u540c\u6837\u503c\u5f97\u6df1\u7a76\u3002<\/p>\n\n\n\n

It’s noteworthy that aside from the aforementioned issues, the careless medication practices of the Neijiang Disciplinary Committee and Supervisory Commission’s case workers, disregarding the physical and mental health of detainees, also merit thorough investigation.<\/p>\n\n\n\n

\u4e00\u3001\u4e0d\u7ecf\u4e13\u4e1a\u533b\u751f\u8bca\u65ad\u548c\u5f00\u5177\u5904\u65b9\uff0c\u8ba9\u8d75\u6c38\u97e6\u670d\u7528\u5927\u91cf\u5904\u65b9\u836f\u30022023\u5e743\u67088\u65e5\u81f38\u670825\u65e5\uff0c\u8d75\u6c38\u97e6\u88ab\u7559\u7f6e\u5728\u5185\u6c5f\u5e02\u76d1\u59d4\u7559\u7f6e\u4e2d\u5fc3\u3002\u88ab\u7559\u7f6e\u4e4b\u524d\uff0c\u9664\u4e86\u9888\u690e\u6709\u4e9b\u8bb8\u4e0d\u9002\uff0c\u4ed6\u5e76\u672a\u60a3\u6709\u5176\u4ed6\u75be\u75c5\u3002<\/strong><\/p>\n\n\n\n

1. Zhao Yongwei was made to take large quantities of prescription medication without diagnoses or prescriptions from professional doctors. From March 8 to August 25, 2023, Zhao Yongwei was detained at the Neijiang City Supervisory Commission Detention Center. Prior to detention, he had no illnesses except for some minor cervical discomfort.<\/p>\n\n\n\n

\u6839\u636e\u7531\u5185\u6c5f\u5e02\u76d1\u59d4\u63d0\u4f9b\u7684\u4fe1\u606f\uff0c\u8d75\u6c38\u97e6\u5728\u7559\u7f6e\u7684171\u5929\u91cc\uff0c\u670d\u7528\u4e86\u4e0d\u540c\u836f\u726933\u79cd\uff0c\u5176\u4e2d\u5305\u62ec\u7ea620\u79cd\u5904\u65b9\u836f\uff0c\u5171\u8ba1\u670d\u7528\u836f\u7269349\u6b21\uff0c\u7c7b\u578b\u591a\u4e3a\u5185\u79d1\u836f\u7269\uff0c\u5305\u62ec\u4e00\u79cd\u7cbe\u795e\u7c7b\u836f\u7269\uff08\u76d0\u9178\u820d\u66f2\u6797\u7247\uff09\uff0c\u8fd9\u4e9b\u670d\u836f\u8bb0\u5f55\u5747\u901a\u8fc7\u6bcf\u65e5\u4f53\u68c0\u62a5\u544a\u4f53\u73b0\uff0c\u62a5\u544a\u672a\u7ecf\u503c\u73ed\u533b\u751f\u7b7e\u5b57\uff0c\u4e5f\u672a\u4f9d\u636e\u4efb\u4f55\u5904\u65b9\u3002<\/p>\n\n\n\n

According to information provided by the Neijiang City Supervisory Commission, Zhao Yongwei took 33 different medications over 171 days of detention, including about 20 types of prescription drugs, totaling 349 instances. These medications were mostly internal medicine, including a psychiatric drug (Sertraline Hydrochloride). These medication records were reflected in daily physical examination reports, which were not signed by an on-duty doctor nor based on any prescription.<\/p>\n\n\n\n

\u5904\u65b9\u836f\u662f\u6307\u6839\u636e\u533b\u751f\u7684\u8bca\u65ad\u548c\u5904\u65b9\u5f00\u5177\uff0c\u9700\u8981\u5728\u8d2d\u4e70\u65f6\u51fa\u793a\u533b\u751f\u5904\u65b9\u3002\u8fd9\u4e9b\u836f\u7269\u901a\u5e38\u88ab\u8ba4\u4e3a\u5177\u6709\u6f5c\u5728\u7684\u5371\u9669\u6027\u3001\u9700\u8981\u7279\u5b9a\u7684\u7528\u836f\u6307\u5bfc\uff0c\u56e0\u6b64\u5728\u8d2d\u4e70\u65f6\u9700\u8981\u533b\u751f\u7684\u4e13\u4e1a\u5efa\u8bae\u548c\u76d1\u7763\u3002<\/p>\n\n\n\n

Prescription drugs are those issued based on a doctor’s diagnosis and prescription, requiring a doctor’s prescription at the time of purchase. These medications are generally considered to have potential risks and require specific medication guidance, hence necessitating professional advice and supervision from a doctor during purchase.<\/p>\n\n\n\n

\u6ca1\u6709\u533b\u751f\u7684\u4e13\u4e1a\u5efa\u8bae\u548c\u76d1\u7763\uff0c\u5927\u91cf\u670d\u7528\u5404\u79cd\u5904\u65b9\u836f\u6781\u6709\u53ef\u80fd\u5bf9\u8eab\u4f53\u548c\u7cbe\u795e\u4ea7\u751f\u6781\u5927\u5730\u635f\u5bb3\u3002<\/p>\n\n\n\n

Without professional advice and supervision from a doctor, the extensive use of various prescription medications can significantly harm one’s physical and mental health.<\/p>\n\n\n\n

\u4e8c\u3001\u5916\u79d1\u5927\u592b\u8ba4\u4e3a\u5e94\u8be5\u5403\u7684\u6297\u6291\u90c1\u836f\u3002\u8d75\u6c38\u97e6\u4e8e5\u670811\u65e5\u5f00\u59cb\u670d\u7528\u76d0\u9178\u820d\u66f2\u6797\u7247\uff0c\u5171\u670d\u7528\u4e5d\u5929\u3002\u76d0\u9178\u820d\u66f2\u6797\u7247\u662f\u4e00\u79cd\u6cbb\u7597\u6291\u90c1\u75c7\u76f8\u5173\u75c7\u72b6\u7684\u5904\u65b9\u836f\u3002<\/strong><\/p>\n\n\n\n

2. The surgeon considered it necessary to use antidepressant medication. Zhao Yongwei began taking Sertraline Hydrochloride on May 11, for a total of nine days. Sertraline Hydrochloride is a prescription medication for treating symptoms of depression.<\/p>\n\n\n\n

\u6839\u636e\u836f\u54c1\u8bf4\u660e\u4e66\uff0c\u6b64\u836f\u5341\u5206\u5e38\u89c1\u7684\u526f\u4f5c\u7528\u6709\u5931\u7720\u3001\u5934\u6655\u5934\u75db\u3001\u8179\u6cfb\u6076\u5fc3\u7b49\uff0c\u5e38\u89c1\u7684\u526f\u4f5c\u7528\u6709\u7126\u8651\u3001\u55dc\u7761\u3001\u8033\u9e23\u3001\u5fc3\u60b8\u3001\u610f\u8bc6\u6a21\u7cca\u3001\u75b2\u52b3\u3001\u76ae\u75b9\u3001\u76ae\u80a4\u53cd\u5e94\u7b49\u3002<\/p>\n\n\n\n

According to the medication instructions, the most common side effects include insomnia, dizziness, headache, diarrhea, nausea, etc., with anxiety, drowsiness, tinnitus, palpitations, blurred consciousness, fatigue, rash, and skin reactions among the common side effects.<\/p>\n\n\n\n

\u8d75\u6c38\u97e6\u672a\u7ecf\u7cbe\u795e\u79d1\u533b\u751f\u8bca\u65ad\u7684\u60c5\u51b5\u4e0b\u670d\u7528\u4e86\u8fd9\u79cd\u836f\u7269\u3002\u5185\u6c5f\u5e02\u76d1\u5bdf\u59d4\u59d4\u8bc1\u660e\u670d\u836f\u7684\u5408\u7406\u6027\uff0c\u4ec5\u63d0\u4f9b\u540d\u4e3a\u6210\u5ddd\u6c5f\u7684\u5916\u79d1\u533b\u751f\u4e8e11\u670815\u65e5\u51fa\u5177\u7684\u201c\u820d\u66f2\u6797\u4f7f\u7528\u60c5\u51b5\u8bf4\u660e\u201d\uff1a\u7ecf\u5e38\u5931\u7720\uff0c\u5fc3\u70e6\u610f\u4e71\uff0c\u51fa\u73b0\u5e7b\u542c\u3002<\/p>\n\n\n\n

Zhao Yongwei took this medication without a diagnosis from a psychiatrist. To justify the medication use, the Neijiang City Supervisory Commission provided only a “Sertraline Usage Explanation” issued by a surgeon named Cheng Chuanjiang on November 15, stating frequent insomnia, irritability, and auditory hallucinations.<\/p>\n\n\n\n

\u4e5f\u4e0d\u77e5\u9053\u5982\u679c\u529e\u6848\u4eba\u5458\u7684\u5bb6\u4eba\u53ef\u80fd\u60a3\u6709\u7cbe\u795e\u75be\u75c5\uff0c\u6562\u4e0d\u6562\u8ba9\u8fd9\u540d\u5916\u79d1\u5927\u592b\u7ed9\u8bca\u6cbb\u3002<\/p>\n\n\n\n

It’s unknown if the case workers would dare let this surgeon treat their family members if they were to suffer from a mental illness.<\/p>\n\n\n\n

\u8d75\u6c38\u97e6\u7684\u6291\u90c1\u75c7\u6709\u4e24\u79cd\u53ef\u80fd\uff1a\u4e00\u662f\u8d75\u6c38\u97e6\u786e\u5b9e\u65b0\u60a3\u4e0a\u4e86\u6291\u90c1\u75c7\uff0c\u5e94\u8be5\u5403\u836f\u6cbb\u7597\u3002\u7136\u800c\uff0c\u591a\u6570\u6297\u6291\u90c1\u836f\u7684\u8d77\u6548\u65f6\u95f4\u4e3a10\u523014\u5929\uff0c\u901a\u5e38\u9700\u89814\u52306\u5468\u624d\u80fd\u5145\u5206\u663e\u6548\uff0c\u53ea\u5403\u4e5d\u5929\u5e94\u8be5\u5bf9\u8d75\u6c38\u97e6\u7684\u6291\u90c1\u75c7\u6cbb\u7597\u6ca1\u4ec0\u4e48\u6548\u679c\uff0c\u52a0\u4e4b\u6ca1\u6709\u540e\u7eed\u6cbb\u7597\uff0c\u8eab\u5904\u957f\u671f\u88ab\u76d1\u7981\u7684\u73af\u5883\uff0c\u6291\u90c1\u75c7\u53ea\u6709\u53ef\u80fd\u52a0\u91cd\u3002<\/p>\n\n\n\n

There are two possibilities regarding Zhao Yongwei’s depression: one, Zhao Yongwei indeed developed depression and required medication. However, most antidepressants take 10 to 14 days to begin working, usually requiring 4 to 6 weeks to become fully effective. Taking it for only nine days would likely have no significant effect on treating Zhao Yongwei’s depression, especially without follow-up treatment and being in a long-term detention environment, which could only worsen the depression.<\/p>\n\n\n\n

\u503c\u5f97\u6ce8\u610f\u7684\u662f\uff0c\u8d75\u6c38\u97e6\u575a\u51b3\u558a\u51a4\uff0c\u8868\u8fbe\u6e05\u6670\u7684\u5ead\u5ba1\u8868\u73b0\uff0c\u5b8c\u5168\u4e0d\u50cf\u6291\u90c1\u75c7\u60a3\u8005\u3002<\/p>\n\n\n\n

It is worth noting that Zhao Yongwei vehemently declared his innocence with a clear expression during the trial, not resembling a patient with depression at all.<\/p>\n\n\n\n

\u4e8c\u662f\u8d75\u6c38\u97e6\u6ca1\u6709\u6291\u90c1\u75c7\u3002\u8d75\u6c38\u97e6\u56e0\u88ab\u7559\u7f6e\u7684\u79cd\u79cd\u906d\u9047\uff0c\u867d\u7136\u53ef\u80fd\u5bfc\u81f4\u6291\u90c1\u75c7\uff0c\u4e5f\u4e0d\u5e94\u8be5\u7acb\u5373\u91c7\u53d6\u836f\u7269\u6cbb\u7597\u7684\u624b\u6bb5\uff0c\u75c5\u60c5\u7684\u53d1\u5c55\u5927\u591a\u9700\u8981\u65f6\u95f4\uff0c\u6291\u90c1\u836f\u7269\u6cbb\u7597\u4e3b\u8981\u662f\u9488\u5bf9\u4e2d\u5ea6\u53ca\u4ee5\u4e0a\u6291\u90c1\u75c7\u60a3\u8005\u3002<\/strong><\/p>\n\n\n\n

The second possibility is that Zhao Yongwei does not have depression. Although the various experiences during detention could potentially lead to depression, immediate medication should not have been the first course of action. The development of the condition generally takes time, and medication treatment is primarily for moderate to severe depression patients.<\/p>\n\n\n\n

\u90a3\u4e48\u7ed9\u8d75\u6c38\u97e6\u5403\u836f\u662f\u4ec0\u4e48\u76ee\u7684\u5462\uff1f\u5728\u670d\u7528\u76d0\u9178\u820d\u66f2\u6797\u7247\u540e\u51e0\u65e5\uff0c\u8d75\u6c38\u97e6\u7684\u65b0\u589e\u7528\u836f\u60c5\u51b5\u5982\u4e0b\uff1a5\u670815\u65e5\uff0c\u589e\u52a0\u836f\u7269\u76d0\u9178\u5e03\u66ff\u8418\u915a\u4e73\u818f\uff08\u4e3b\u8981\u7528\u4e8e\u6cbb\u7597\uff1a\u8db3\u8dbe\u7663\u3001\u4f53\u7663\u3001\u80a1\u7663\uff09\uff1b5\u670818\u65e5\uff0c\u589e\u52a0\u836f\u7269\u963f\u6258\u4f10\u4ed6\u6c40\u9499\u7247\uff08\u4e3b\u8981\u7528\u4e8e\u6cbb\u7597\uff1a\u51a0\u5fc3\u75c5\uff0c\u9ad8\u80c6\u56fa\u9187\u8840\u75c7\uff09\u3002<\/p>\n\n\n\n

What was the purpose of medicating Zhao Yongwei then? Following a few days of taking Sertraline Hydrochloride, the following medications were added: on May 15, Clotrimazole Cream (mainly for treating tinea pedis, tinea corporis, and tinea cruris); on May 18, Atorvastatin Calcium Tablets (mainly for treating coronary artery disease, hypercholesterolemia).<\/p>\n\n\n\n

\u901a\u8fc7\u8fd9\u4e24\u4e2a\u65b0\u589e\u7528\u836f\uff0c\u6211\u4eec\u53ef\u4ee5\u63a8\u65ad\uff0c\u8fd9\u6bb5\u65f6\u95f4\u5185\u8d75\u6c38\u97e6\u6709\u76ae\u80a4\u75c5\u53ca\u5fc3\u810f\u4e0d\u9002\u7684\u60c5\u51b5\u3002\u90a3\u4e48\uff0c\u670d\u7528\u7684\u6297\u6291\u90c1\u836f\u7269\u4e0e\u8d75\u6c38\u97e6\u540e\u7eed\u8eab\u4f53\u4e0d\u9002\u7684\u53cd\u5e94\u662f\u5426\u6709\u5173\u5462\uff1f\u8d75\u6c38\u97e6\u5931\u7720\u3001\u8033\u9e23\u3001\u7126\u8651\u7b49\u75c7\u72b6\u52a0\u91cd\uff0c\u662f\u5426\u662f\u8fd9\u79cd\u836f\u7269\u5bfc\u81f4\u7684\uff1f<\/p>\n\n\n\n

From these two additional medications, we can infer that Zhao Yongwei experienced skin conditions and heart discomfort during this period. Thus, could the reactions of physical discomfort following the antidepressant medication be related? Did the medication cause Zhao Yongwei’s worsening symptoms of insomnia, tinnitus, and anxiety?<\/p>\n\n\n\n

\u76ee\u524d\u63d0\u4f9b\u768416\u4efd\u7b14\u5f55\u91cc\uff0c\u627f\u8ba4\u53d7\u8d3f\u7684\u4f9b\u8ff0\u90fd\u662f\u5728\u670d\u836f\u4ee5\u540e\uff0c\u800c\u670d\u836f\u524d\u7684\u4f9b\u8ff0\u5747\u672a\u627f\u8ba4\u53d7\u8d3f\uff0c\u8fd9\u4e24\u8005\u662f\u5426\u6709\u4e00\u5b9a\u7684\u8054\u7cfb\uff1f<\/p>\n\n\n\n

In the 16 available records, the confessions of bribery were all made after medication, whereas the statements before medication did not admit to bribery. Is there a connection between the two?<\/p>\n\n\n\n

\u5bf9\u4e8e\u8d75\u6c38\u97e6\u5728\u7559\u7f6e\u671f\u95f4\u88ab\u4e0d\u5f53\u4f7f\u7528\u836f\u7269\u7684\u95ee\u9898\uff0c\u8fd9\u4e0d\u4ec5\u4ec5\u6709\u5173\u8d75\u6c38\u97e6\u7684\u6e05\u767d\u53ca\u529e\u6848\u4eba\u5458\u7684\u6cd5\u5f8b\u8d23\u4efb\uff0c\u66f4\u7275\u6d89\u5230\u5bf9\u533b\u7597\u4f26\u7406\u548c\u53f8\u6cd5\u516c\u6b63\u7684\u6df1\u523b\u53cd\u601d\u3002<\/p>\n\n\n\n

The issue of Zhao Yongwei being improperly medicated during detention concerns not only his innocence and the legal responsibility of the case workers but also calls for profound reflection on medical ethics and judicial fairness.<\/p>\n\n\n\n

Firstly, the appropriateness of medication use during detention should be a focal point of concern. Zhao Yongwei was forced to take a large amount of prescription medication, including a psychiatric drug, without a diagnosis from a professional doctor. This not only violates the normal medical process but could also cause genuine harm to his physical and mental health.<\/p>\n\n\n\n

\u5176\u6b21\uff0c\u836f\u7269\u662f\u5426\u6210\u4e3a\u4e86\u4ed6\u53e3\u4f9b\u771f\u5b9e\u6027\u7684\u5e72\u6270\u56e0\u7d20\uff1f\u8fd9\u4e00\u70b9\u65e2\u5173\u7cfb\u5230\u53f8\u6cd5\u516c\u6b63\uff0c\u4e5f\u5173\u7cfb\u5230\u4e2a\u4f53\u7684\u6743\u76ca\u548c\u5e87\u62a4\u3002<\/p>\n\n\n\n

Secondly, did the medication become an interfering factor in the authenticity of his confession? This issue relates to both judicial fairness and the rights and protection of the individual.<\/p>\n\n\n\n
